Welcome to OathNet ("we," "our," or "us"). By accessing or using our website, services, APIs, or applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a legally binding agreement between you and OathNet regarding your use of the Services. Please read them carefully.

2. Service Description

OathNet provides open-source intelligence (OSINT) and cybersecurity services that allow users to search for and analyze publicly available information. Our Services include, but are not limited to, email lookups, username searches, IP information, and data breach notifications.

We do not guarantee the accuracy, completeness, or usefulness of any information obtained through our Services. The information provided is for informational purposes only.

3. Account Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Acceptable Use

You agree not to use the Services for any illegal, harmful, fraudulent, infringing, or objectionable purposes. Prohibited activities include, but are not limited to:

  • Violating any applicable laws or regulations
  • Infringing upon the rights of others, including intellectual property rights
  • Harassing, threatening, or intimidating others
  • Attempting to gain unauthorized access to our systems or user accounts
  • Using the Services to stalk, harass, or harm another individual
  • Collecting or harvesting personal information about other users without their consent
  • Interfering with or disrupting the Services or servers or networks connected to the Services
  • Circumventing usage limitations or API rate limits

5. API Usage and Rate Limits

If you use our API, you agree to abide by our rate limits and other technical restrictions. We reserve the right to modify these limits at any time. Excessive use or abuse of our API may result in temporary or permanent suspension of your access.

6. Privacy

Our Privacy Policy, available at the privacy page, describes how we collect, use, and share information about you when you use our Services. By using our Services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

7. Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by OathNet, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Services or any content, features, or functionality thereof.

8. Public Telemetry License

OathNet may publish aggregate, non-user-specific telemetry about the platform, including indexed record counts, recent ingestion totals, and trusted user counts. This public telemetry is provided for informational, search, and citation purposes only.

You may reference this public telemetry with attribution to OathNet and a link to https://oathnet.org. This permission does not grant access to, redistribution rights for, or a license to underlying breach records, stealer logs, customer data, private search results, API responses, exports, or other protected Services content.

9. Payments, Billing, and Refunds

Paid subscriptions, credits, and other purchased services are billed in advance according to the plan and billing interval you choose at checkout.

Card or bank payments may be refunded if you contact us within 14 calendar days of the original purchase date. Refund requests are reviewed on a case-by-case basis and may be denied in cases of fraud, abuse, chargeback risk, or material use of the Services before the request is made.

If you request an upgrade within 14 calendar days of purchase, we may, in our sole discretion, issue a coupon or account credit reflecting some or all of the remaining value of your current plan so you only pay the difference for the upgraded plan. Upgrade adjustments are handled case by case and are not guaranteed.

Payments made with cryptocurrency are final. Due to blockchain network fees, payment processor charges, and conversion costs that are typically non-recoverable once a crypto invoice is issued or paid, we do not offer refunds for cryptocurrency payments except where required by applicable law.

Unless otherwise stated at checkout, subscriptions renew automatically for the same billing interval until canceled. Cancelling a subscription stops future renewals but does not automatically create a refund for the current billing period.

You are responsible for any applicable taxes, duties, network fees, currency conversion charges, or other third-party payment costs associated with your purchase unless we expressly state otherwise.

If you believe a charge was made in error, you must contact us first at [email protected] before initiating a payment dispute or chargeback so we can review the issue. Fraudulent or abusive disputes may result in suspension or termination of your account.

By completing a purchase, you confirm that you reviewed this payment policy before checkout.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES ARE ACCURATE, ERROR-FREE, RELIABLE, OR WILL MEET YOUR REQUIREMENTS, OR THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

IN NO EVENT SHALL OATHNET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

12. Indemnification

You agree to defend, indemnify, and hold harmless OathNet, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Services caused damage to a third party.

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Europe, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
